The 36-page decision handed down from two New Jersey judges at McGillvary’s 2019 trial detailed that the jury didn’t believe his testimony that he was acting in self-defense after he says Galfy drugged and raped him.
McGillvary told police that he believed Galfy drugged him and sexually assaulted him on the first night he spent at his house, and then again on the following night when he returned.
They also questioned why McGillvary was unable to recall the whereabouts of the clothing he was wearing during the attack, which he says was soaked in blood and urine, despite his “remarkable memory” about other details from that night.
The decision also notes that McGillvary changed clothes and cut his hair directly after the incident.
