Between May 12, the date of the 2013 incident with Galfy in Clark, New Jersey, and May 16, the date McGillvary was picked up by police at a Greyhound bus station in Philadelphia, Pennsylvania, the decision details McGillvary’s whereabouts and actions.

Immediately following the incident on May 12, McGillvary called Kimberly Conley-Burns, a fan of his who had found him on Facebook and offered to help him find a place to stay if he was ever in New Jersey. He called her asking for a place to stay that evening, saying that his housing situation “fell through.”

When she did not answer, he appeared at the White Diamond Diner in Clark between 10:00 and 10:15 p.m. He then went to a 7-11 in Clark asking for directions to the Rahway train station, telling the 7-11 employee that he was looking for the “quickest” way out of Clark. McGillvary then got on a train to Long Branch, which arrived shortly after 2:30 a.m. on the 13th.

That day, he spoke to Conley-Burns on the phone before meeting her at Asbury Park train station, explaining that he had cut his hair using a knife and that he had been raped by Galfy.

McGillvary spent the next few days with friends in Philadelphia who said that he had been acting “weird” before he was picked up by police at the Greyhound bus station on the 16th.
